Terms of service

Last updated

These terms are the agreement between you and the person who runs Rotea. They apply when you use Rotea on the web, in the iPhone app or through its API, and you accept them by creating an account. What Rotea does with your personal data is in the privacy policy.

Who provides Rotea

Rotea is provided by DENIS ERMAKOV PR BEOGRAD, a sole trader (preduzetnik) registered in Serbia: “we” and “us” in these terms. They are the same person the privacy policy names as the controller.

For help with Rotea, or a question about these terms, write to us through the Contact page. A person reads the messages we receive.

The service

Rotea is a flashcard app for learning languages. Each card has a phrase in the language you learn, its meaning in yours, and recordings of both, and you train with them by spaced repetition. You can write cards of your own and add cards from Rotea's collections.

You must be at least 16 to create an account and use Rotea. By creating one, you confirm that you are.

Training with Rotea takes a plan, which starts with a free trial. On the web it is a web plan, paid in roubles: what it costs, its trial, auto-renewal and refunds are under The web plan. In the iPhone app it is a subscription sold by Apple, under Subscriptions and payments. One plan works on both.

Rotea is a learning aid. Its recordings, translations and labels are made partly by automated services and may contain mistakes, so do not rely on them where accuracy matters.

If you use the iPhone app, the App Store's standard terms for apps also apply to it. Apple is not a party to these terms and is not responsible for Rotea or its support.

Your account

You sign in with Google, with your email and a password, or on the iPhone with Apple. Whoever can sign in to that account or read that mailbox can use your Rotea account, so keep them secure. The API tokens you create act as your account: keep them secret, and revoke any you no longer use in your settings. If you think someone else has used your account, tell us through the Contact page.

You can delete your account at any time: on the web in Account settings, or in the iPhone app's settings. If you signed up with Apple, delete it from the iPhone app, or write to us. Deleting the account turns off a web plan's auto-renewal; it does not cancel an iPhone subscription, which you cancel with Apple. You are signed out on every device at once, and your account and its data are erased from Rotea's database about 14 days later; signing in before then cancels the deletion. A few things stay, such as the collections you added cards from, which are not yours; copies outside the database, such as logs, go later. The privacy policy says what and for how long, under How long we keep it.

We may suspend or close an account that seriously or repeatedly breaks these terms, or when the law requires us to. You can ask us why through the Contact page.

Your content

The text you write on your cards stays yours. You allow us to store it, copy it and process it only as far as running Rotea for you needs: to keep it, show it on your devices, make its recordings and label it. That permission ends when your content is erased, apart from the copies that go later, described under How long we keep it. Your cards are not shown to other learners. Rotea's administrators can see your account, cards and recordings, to give support and to check the content learners share, such as collections and labels.

Recordings are made by text-to-speech from the card's text: the text is sent to a speech service, which returns the audio. Rotea never records your voice. A language model labels your cards with their level and grammar. It judges the text, not you.

These services are run by other companies, listed in the privacy policy under Who else receives it. Please do not put personal information about yourself or others in your cards: their text is sent to the speech and labelling services.

You are responsible for what you put on your cards: you must have the right to use it, and it must not break the law. Rotea's collections, with their cards and recordings, are offered for learning in Rotea: you may learn from them there, but not copy them out in bulk or publish them elsewhere.

Acceptable use

When you use Rotea, please do not:

  • break the law, or put on your cards anything unlawful, or that infringes someone else's rights;
  • try to reach another learner's account or data, or anything of Rotea's you are not given;
  • test, probe or attack Rotea's security (if you find a weakness, please tell us through the Contact page instead);
  • get round Rotea's limits, such as those on credits and on repeated requests, or load it more than ordinary use would;
  • use Rotea by automated means other than its API, with your own tokens and within its limits, or copy its collections in bulk;
  • sell access to Rotea, or let others use your account.

Availability, and no warranty

We work to keep Rotea running and your data safe, but Rotea is provided as it is and as available. We do not promise that it will always be available or free of errors, that its recordings, translations and labels are correct, or that your data can never be lost: keep your own copy of anything you cannot do without. Some parts of Rotea depend on other companies' services, such as sign-in and speech; when those are down, those parts may not work.

We may change Rotea, add or remove features, or stop providing it. If we stop providing it altogether, we will tell you in advance where we can, so that you can ask for a copy of your data.

Limitation of liability

As far as the law allows, we are not liable for indirect or consequential loss, for loss of data, profit or opportunity, or for loss caused by events beyond our reasonable control or by other companies' services.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited, and nothing in them takes away the rights you have by law as a consumer.

Changes to these terms

We may change these terms, for example when Rotea or the law changes. When they change, this page is updated and the date at the top says when; the version on this page is the one that applies. If a change matters to you, we will also tell you in Rotea where we can. If you do not agree with a change, you can stop using Rotea and delete your account.

Governing law

These terms are governed by the law of Serbia. If you are a consumer living in the EU or the UK, you also keep the protection of the mandatory consumer law of the country you live in, and you may bring a claim in its courts where that law allows. A web plan bought as a consumer in Russia is governed by Russian law, under Seller of web plans.

If something goes wrong, please write to us through the Contact page first: most problems can be put right that way.

The web plan

Rounds, collections and adding cards on the web take a plan. Creating an account takes none, and an account without a plan can still open Settings, export its data and delete itself.

A web plan costs 290 ₽ a month (the Monthly plan) or 2,900 ₽ a year (the Yearly plan). It is paid in roubles through YooKassa, the payment service of NBCO YooMoney LLC (ООО НКО «ЮMoney»), by a Russian bank card or by SBP. The price is fixed when you start the plan and stays for its renewals while your auto-renewal consent stands. Prices are without VAT: the seller uses the simplified tax system.

Each paid period gives access to every collection at every level, every phrase voiced, your streak, goal and progress, and credit for the phrases you write yourself: your balance is brought up to 10,000 credits (about 400 phrases) each month on the Monthly plan, or 240,000 (about 9,600) a year on the Yearly plan. It is brought up to that level, not added on top: credit above it is not lowered, and unused credit below it does not carry over.

The trial. A web plan starts with 14 free days. They start when you save a bank card at YooKassa with your consent to auto-renewal; nothing is charged then (0 ₽). On day 15 the card is charged the plan's price and the first paid period starts, unless you have turned auto-renewal off before then. If you turn it off during the trial, access lasts to the trial's last day; then Rotea asks you to choose a plan, and your cards, streak and progress stay. The web trial is given once per account; once used, a web plan is paid when you start it. The trial adds 500 credits once per account, on the web and on the iPhone together; 375 to an account that opened with 125, so 500 together. Learners whose account existed when the web became paid get 14 days once, with no bank card, and an email that says so.

How you get access. The plan is on in your Rotea account as soon as YooKassa confirms the payment or the saved card, usually within seconds; if your bank takes longer, we email you the result. There is nothing to download or activate.

One plan per account. A plan belongs to your Rotea account, not to a device, a bank card or an Apple Account, and works on the web and in the iPhone app when you sign in the same way. While an iPhone subscription is active, a web plan cannot be started.

You accept these terms for a web plan when you save a bank card with the auto-renewal consent, pay for a plan, or redeem a promo code. A web plan is sold under the public offer in Russian at rotea.app/ru/terms (публичная оферта), which these sections follow; if the two differ, the offer applies to web plans. The seller of web plans is named under Seller of web plans.

Auto-renewal of a web plan

A web plan renews automatically. When you start one, you tick a consent, never ticked in advance, that names the amount, how often it is charged, the first charge's date and how to turn it off; its text, version and time are kept. You type your card on YooKassa's page only: Rotea never sees or keeps its number, only YooKassa's reference to the saved card and its label, such as “Mir •• 4444”.

  • Each renewal charges the plan's price on the same day of the next month or year (the last day of a month that has no such day).
  • We email your account's address at least 24 hours before every automatic charge, with the amount, the date, the card and a link to turn auto-renewal off. No charge is made without that email.
  • If your bank reissues the card, the charge may go to the new card.
  • If a charge fails, it is tried again 1, 3 and 5 days after the due date, and we email you each time; your access goes on while the tries run. If the last try fails, the plan ends. A refusal that cannot succeed later (a blocked or expired card, suspected fraud) ends it at once. You can change the card in Settings → Account → Plan.
  • Turn off auto-renewal at any time in Settings → Account → Plan, by the link in the renewal emails, or by writing to hello@rotea.app. Turned off in Settings or by the link, the saved card is deleted from Rotea at once and can never be charged again; by email, it is done by the next working day, and before any charge due sooner. The period you paid for (or the trial) runs to its end, and we confirm by email. Turning it back on means saving a card again, with consent.
  • After you turn it off, your card is not used for recurring payments; if a charge were made after that, it would be refunded in full.

A price change for a running plan applies only if you give a new consent with the new price; we tell you by email at least 14 days before the next charge, and without a new consent the plan runs to the end of its period and does not renew.

Refunds for web plans

You can withdraw from a web plan at any time. We refund the unused part of the period you paid for: the period's price × the whole days left ÷ the days in the period. Write to us from your account's email at hello@rotea.app or through the Contact page; you do not need to give a card number. The refund is paid within 10 days, to the card or account the payment came from (when it arrives depends on your bank), and YooKassa sends its receipt. The plan ends on the day of the refund, with auto-renewal off.

If Rotea is unavailable through our fault for more than 24 hours in a row, write to hello@rotea.app and we add 5,000 extra credits to your account. We may also refund in part on our own initiative; such a partial refund leaves the plan running, a full refund ends it. Credit already added is never taken back. The trial is free, so there is nothing to refund for it. Refunds of iPhone subscriptions are Apple's, under Subscriptions and payments.

Promo codes

We give promo codes at our discretion, for example to testers. A promo code gives access for the number of days it names and brings your credit up to the Monthly plan's level, with no bank card and no charge. Codes are redeemed on the web only, in Settings → Account → Plan, once per account per code; a code may have an expiry date and a limit on its uses. A code cannot be redeemed while a paid web plan or an iPhone subscription is active (a web trial is not a paid plan). Promo codes have no cash value and cannot be moved to another account. When a promo plan ends, Rotea asks you to choose a plan; your cards and progress stay.

Seller of web plans

Web plans are sold by an individual entrepreneur registered in Russia. If you buy a web plan as a consumer, the law of the Russian Federation governs that purchase and Russian consumer law protects you; you may bring a claim in the court where you live. Claims can be sent to hello@rotea.app or to the postal address below, and are answered within 10 days.

Subscriptions and payments

Credits pay for the recordings and labels of the phrases you write yourself. Each account opens with 5,000 credits, enough for about 200 of them; phrases you add from Rotea's collections use none. An account made once the web became paid opens with 125 credits, about 5 phrases, instead. A plan brings them up to its level: a web plan as The web plan says, an iPhone subscription as below.

On the iPhone, the app offers a subscription: a plan that gives the same access, on the iPhone and on the web, and adds credits to your account. Subscriptions are sold and billed by Apple through the App Store, with the payment method of your Apple Account, at the price the App Store shows you before you buy, in your currency. We do not take the payment and never see your card details.

A subscription renews automatically at the end of each period until you cancel it. You can cancel at any time in your Apple Account's subscription settings (on the iPhone: Settings, your name, Subscriptions). To stop the next renewal, cancel at least 24 hours before the end of the current period; the period already paid for runs to its end. Deleting your Rotea account or the app does not cancel a subscription: Apple bills it until you cancel it with Apple.

A new subscription may start with a free trial of 14 days, as the App Store offers it. Unless you cancel at least 24 hours before the trial ends, the subscription continues and Apple charges you for the first paid period when the trial ends.

What a subscription gives your account:

  • When the app reports a paid period to Rotea (it does so when you buy and when you open the app), your credits are brought up to 10,000 for the monthly subscription or 240,000 for the yearly one, once for each period. If your balance is already higher, it is not lowered.
  • Credits are not added on top of what is left: a renewal raises the balance to the level, so unused credits below it do not carry over into the next period.
  • The free trial adds 500 credits once, when the app reports it (375 to an account that opened with 125, so 500 together). A Rotea account gets the trial's credits only once, whichever Apple Account the subscription is bought with. The levels above start with the first paid period.
  • The credits are your account's, so you can use them on the web as well.
  • When a subscription ends, the credits left in your account stay as they are. They are no longer refilled.

Credits have no money value: they cannot be sold, transferred to another account or exchanged for money. What each subscription costs and gives is also on the Pricing page.

Refunds and cancelling a purchase are handled by Apple under Apple's terms: to ask for a refund, use Apple's Report a Problem page or contact Apple. We cannot refund App Store purchases ourselves. Credits already added stay in your account if a purchase is refunded; no further credits are added for it. If you live in the EU or the UK, you may have a right to withdraw from a purchase within 14 days; for a purchase in the App Store, that right is exercised with Apple, under Apple's terms. Nothing in these terms takes away the rights you have by law as a consumer.
